RELEASE AND INDEMNITY
- NO LIABILITY: THE CUSTOMER ACKNOWLEDGES THAT THERE ARE CERTAIN RISKS AND HAZARDS ASSOCIATED WITH THE ACTIVITIES TO WHICH THE PERMIT REFERS AND ACCEPTS ALL SUCH RISKS. THE CUSTOMER AGREES THAT TORONTOAND REGION CONSERVATION AUTHORITY (“TRCA”), AND EVERYONE CONNECTED WITH IT, INCLUDING ITS MEMBERS OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, SUCCESSORS AND ASSIGNS, SHALL NOT BE RESPONSIBLE FOR ANY DEATH, PERSONAL INJURY, LOSS OR DAMAGE TO PROPERTY WHICH MAY OCCUR IN ANY WAY RELATED TO THE ISSUING OF THE PERMIT, HOWEVER SUCH DAMAGE IS CAUSED, INCLUDING NEGLIGENCE OF TRCA, AND THE CUSTOMER HEREBY RELEASES ANY SUCH CLAIMS AGAINST TRCA AND EVERYONE CONNECTED WITH IT, INCLUDING ITS MEMBERS OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, SUCCESSORS AND ASSIGNS.
- INDEMNITY: THE CUSTOMER AGREES TO INDEMNIFY TRCA AND EVERYONE CONNECTED WITH IT INCLUDING ITS MEMBERS OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, SUCCESSORS AND ASSIGNS, IN THE EVENT ANY CLAIMS ARE MADE AGAINST TRCA IN CONNECTION WITH ANY DEATH, PERSONAL INJURY, LOSS OR DAMAGE TO PROPERTY WHICH IS CONNECTED TO THE CUSTOMER OR ANY MEMBER OF THE CUSTOMER’S FAMILY, GUESTS OR INVITEES, AND/OR IN CONNECTION WITH THE ACTIONS OF THE CUSTOMER OR ANY MEMBER OF THE CUSTOMER’S FAMILY, GUESTS AND INVITEES. THE CUSTOMER ACKNOWLEDGES THAT IT IS PRUDENT TO HOLD INSURANCE TO PROTECT AGAINST THESE POSSIBLE LOSSES AND IF INSURANCE IS NOT OBTAINED, THE CUSTOMER DOES SO AT ITS OWN RISK.
TERMS AND CONDITIONS
This material is provided for information only and is not intended to be a complete summary of the regulations or operating policies of Toronto and Region Conservation Authority (“TRCA”). All activities within a Conservation Park are subject to federal, provincial and municipal laws and regulations and related TRCA Policies.
- The picnic permit is valid only for the date and location specified on the permit.
- Picnic site rental fees do not include admission fees into the park or other paid programs (such as events, swimming, fishing, etc.)
- The Permit Holder agrees to be responsible for the conduct and discipline of invitees in attendance for the purposes of the Permit, including abiding by all Federal, Provincial and Municipal laws, by-laws, policies and regulations, and any other conditions which may be set out by TRCA.
- TRCA may revoke the picnic permit without refund and evict any or all persons whose conduct and/or actions violate any of these terms and conditions.
- TRCA provides a safe and respectful environment for its visitors and staff to enjoy. There is zero tolerance for verbal or physical abuse. Inappropriate behaviour will result in removal from TRCA properties and/or and may be reported to the police.
- The Permit Holder and their invitees shall comply with all applicable federal, provincial and municipal laws, ordinances, by-laws and regulations, and shall secure all necessary approvals and permits that are applicable to the picnic booking.
- The Permit Holder is responsible to pay for all damages and/or costs to clean the facility and/or furnishings caused by the permit group. In the event the Property is damaged and/or not returned to its original condition (including left with garbage, permit holder’s property, etc.) as determined by TRCA, the Permit Holder will forfeit the security deposit in its entirety.
- Cancellation Policy: Please note that TRCA parks are outdoor venues and bookings/events should be considered “rain or shine”. The booking is non-refundable. The booking may be re-scheduled depending on availability, provided a minimum of 2 weeks’ notice is received before the booking date. All booking changes will incur a fee. The change fee is outlined in TRCA’s Board Approved Fee Schedule for Public Facilities and Programming.
- Arrival: A representative from your group must be at your reserved site by 9AM to avoid losing exclusive use of picnic site and picnic tables.
- Hours of Facility Access: The hours of the booking are based on regular park operating hours.
- Hours of Operation: Park operating times vary during the season. Be sure to check the posted closing times prior to entry or visit trcaparks.ca for more information.
- Sound Equipment: The use of amplified sound systems, including the use of microphones, is prohibited unless authorized in writing by TRCA. Authorization may be withheld at TRCAs sole discretion. The Permit Holder must obtain authorization from TRCA at least seven (7) business days prior to the booking date. If authorization is obtained, the Permit Holder must be respectful of other patrons in the area. TRCA has the right to revoke the authorization at any time and without notice. TRCA will revoke the authorization where, at the sole discretion of TRCA and its employees, the sound is excessive, disruptive to others, offensive and/or inappropriate.
Sound equipment will not be permitted at the following parks and picnic sites:
Boyd Conservation Area
Bruce’s Mill Conservation Area – Golfview Site
Glen Haffy Conservation Area – Forest View site
Heart Lake Conservation Area – Birchview 1 site
Petticoat Creek Conservation Area - Swimming: : Swimming is not permitted in rivers and lakes. Swimming is only permitted in designated swimming pools.
- Parking: Parking is permitted only in designated parking areas. Improperly parked vehicles may be tagged and/or towed.
- Fires: Ground fires are permitted in designated firepits only, by special permit or in conjunction with a Camping Permit. Movement of any wood materials within, into or from TRCA property is strictly prohibited.
- Alcohol Policy: The consumption and/or sale of alcohol is strictly prohibited unless otherwise specified by TRCA in a written agreement.
- Barbeques: The safe use of barbecues is permitted. Please dispose of ashes in the appropriate containers identified on site.
- Entertainment Vendors: Prior written authorization from TRCA, permits and insurance are required for entertainment vendors.
- Inflatable Devices and/or Tents: Any structure larger than 10’ x 10’ square feet and any inflatable device will not be permitted without appropriate insurance.
- Caterers: TRCA requires caterers to meet the requirements and regulations of the municipal public health department in the city that their business is registered in. Vendors must provide proof of $5 million liability insurance, naming TRCA as Additional Insured. A copy of the insurance certificate is required a minimum of one (1) month prior to the event for the booking to be approved. Note: If the above requirements are not completed by the times mentioned above, the caterer will be refused access to TRCA properties due to liability and safety requirements.
- Theft: TRCA is not responsible for any lost, stolen, or damaged items of the Permit Holder or their guests. Do not leave valuables unattended.
- Vulnerable Sector Screening: TRCA recommends that vendors providing entertainment services obtain at their own expense a clear Vulnerable Sector Screening by the police for all employees who will be performing services on TRCA property who will have direct, unsupervised contact or direct physical contact with vulnerable persons.
